1. Definitions

In these terms and conditions, we use the following definitions:

Studio Sascha:

The sole proprietorship Studio Sascha, based in the Netherlands

Services:

Web design, branding, website maintenance and related services

Customer:

The natural or legal person who purchases services from Studio Sascha

Website:

The website(s) designed and realized by Studio Sascha

Agreement:

The legal relationship between Studio Sascha and the Client for the provision of Services

2. Applicability

2.1 These General Terms and Conditions apply to all offers, agreements, and services of Studio Sascha.

2.2 Deviations from these Terms and Conditions are only valid if agreed upon in writing and expressly.

2.3 By purchasing via the website, the Customer agrees to these terms and conditions.

3. Offers and Agreements

3.1 The services offered on the website constitute a binding offer.

3.2 An agreement is concluded at the moment the Customer purchases a service or program via the website and the payment has been successfully completed.

3.3 Execution starts after all necessary information has been fully provided by the Client.

3.4 Studio Sascha reserves the right to refuse an application or to request additional information.

3.5 The Client agrees that the performance of the Service commences on the start date chosen by the Client or agreed upon in writing via the intake form or planning system.

3.5 The Client agrees that the performance of the Service commences at the time of the scheduled introductory meeting or on another start date agreed upon in writing.

3.6 Performance of the Service is understood to mean all activities within the process, including intake, preparation, and execution.

3.7 The Customer has the right to withdraw from the agreement within 14 days of purchase, provided that Studio Sascha has not yet started performing the work.

3.8 If Studio Sascha has commenced the performance of the Service with the Customer's consent within 14 days of purchase, the right of withdrawal shall lapse at the moment of commencement of the work.

4. Project Description and Quotations

4.1 The content and execution of the Services are based on the information provided by the Client and the agreements as set out at the time of purchase of the program.

4.2 The Client is responsible for the complete and correct provision of all necessary information, content, and materials, in accordance with the deadlines set out in Article 8.

4.3 If the information provided by the Client proves to be incomplete or incorrect, this may affect the execution, planning, and final result of the project.

4.4 Changes or additions to the Client's original wishes after the conclusion of the agreement may lead to:

Adjustment of the schedule
Additional work
Additional costs

4.5 Work that does not fall under the agreements as agreed upon at the time of purchasing the program or as described in the chosen package will be considered additional work and charged separately.

5. Prices and Payment

5.1 All prices on the Studio Sascha website are displayed in euros and exclude VAT, unless otherwise stated.

5.2 Payment for Services and programs must be made in full in advance via the offered payment methods.

5.3 An agreement is only concluded and work is only scheduled after full payment has been received.

5.4 Payments for courses are non-refundable, unless otherwise agreed in writing.

5.5 If the Customer is a consumer, they have the right to dissolve the agreement within 14 days of purchase, provided that Studio Sascha has not yet started performing the work.

5.6 The work commences at the kick-off meeting. This meeting will only be scheduled after the strategic intake has taken place, the Client has signed the engagement agreement, and the first installment of 50% has been paid. After signing the engagement agreement, dissolution is no longer possible. The Client may, however, terminate the Agreement prematurely; in that case, Article 17 applies.

5.7 Price changes are reserved for projects lasting longer than 3 months.

6. Additional work

6.1 Work falling outside the agreed scope of the Agreement shall be considered additional work and charged at an hourly rate of €75.00.

6.2 Additional work includes, among other things:

Additional revisions beyond the agreed number
Modifications to the original design
Additional functionalities not included in the quotation

6.3 Additional work is always discussed with the Client in advance and carried out after approval.

7. Revisions per Package

7.1 A revision round is defined as a single collection moment at which the Client provides bundled feedback on the draft delivered by the User. This feedback should preferably be provided in writing or by e-mail.

7.2 The number of included revision rounds depends on the chosen track:

Basic track: 1 revision round.
Standard track: 2 revision rounds.
Premium track: 3 revision rounds.

7.3 Feedback must be provided by the Client within 10 working days after the presentation of the concept. If no feedback is received within this period, the concept shall be deemed approved and the relevant phase concluded.

7.4 Revisions relate to the refinement of the agreed design (such as textual adjustments, color usage, or images). Changes resulting in an alteration of the previously approved structure, functionalities, or functional design fall outside the definition of 'revision' and will be charged as additional work.

7.5 If the Client wishes more revision rounds than are included in the package, these will be performed based on the User's applicable hourly rate, unless otherwise agreed in writing.

8. Timing and Planning

8.1 Deadlines given by Studio Sascha are not binding unless confirmed in writing in an agreement.

8.2 Studio Sascha will endeavor to meet deadlines but accepts no liability for delays.

8.3 Delay may occur due to:

Late or incomplete provision of information by the Customer
Changes during the project
Unforeseen technical problems
External factors beyond Studio Sascha's control

8.4 The Customer is obliged to provide information, feedback, and approvals in a timely manner.

9. Customer portal

9.1 Studio Sascha may grant the Client access to an online client portal. Whether this is available will be disclosed at the commencement of the Agreement.

9.2 If the customer portal is available, the Customer can therein:

Log in at any time (24/7)
Follow the progress of their project
Keeping track of communication with Studio Sascha

9.3 The portal is always available (24 hours a day, 7 days a week). Studio Sascha regularly posts updates in the portal regarding the progress of the project. This is done manually, so it is not a live feed – updates are added by Studio Sascha as progress is made.

9.4 Studio Sascha is available for questions and support on business days (Monday to Friday, 10:00 AM - 5:00 PM). Outside these hours, customers can use the portal and leave messages, which we will handle as soon as we are available.

9.5 Studio Sascha may modify, temporarily disable, or terminate the client portal. This shall not affect the performance of the Agreement; in that case, communication shall take place via email.

10. Hosting and Domain Registration

10.1 Studio Sascha does not offer hosting and domain registration as standard, unless agreed separately.

10.2 If Studio Sascha provides these services:

Costs are invoiced separately
Studio Sascha acts on behalf of the Customer
The Customer is ultimately the owner of the domain and hosting.

10.3 The Customer is responsible for:

Website backup and security via the hosting provider.
Updates and patches (unless maintenance has been agreed)
Compliance with hosting terms

11. Cookies & Tracking Technologies

11.1 Studio Sascha uses cookies and tracking technologies on the website for various purposes.

11.2 Types of cookies we use:

Essential cookies: Necessary for the operation of the website (security, functionality)
Analytics cookies: Google Analytics - for analysis of website usage
Tracking cookies: Mouseflow - for analysis of user behavior (heatmaps, sessions)
Marketing cookies: For retargeting and marketing purposes

11.3 Visitors must give explicit consent for non-essential cookies before they are placed via our cookie banner.

12. Website maintenance

12.1 Website maintenance packages are optional and can be ordered separately.

12.2 Maintenance packages may consist of:

Monthly/quarterly updates
Security checks
Performance optimization
Backups
Technical support

12.3 Minimum maintenance period: 1 month. Cancellation: at least 1 month in advance.

13. Copyright and Intellectual Property

13.1 All designs, code, and creative work created by Studio Sascha are protected by copyright.

13.2 The Client receives a license to operate the developed Website for its own commercial use.

13.3 Studio Sascha reserves the right:

To use the Website in portfolios and case studies
to publish before and after images on social media, unless the Client expressly prohibits this
Reusing self-made elements and code in other projects

13.4 The Customer may not resell the Website or parts thereof to third parties or grant licenses for them without permission.

13.5 Content provided by the Customer remains the property of the Customer.

14. Warranty

14.1 Studio Sascha provides a 14-day warranty after completion of the project.

14.2 During this period, the following may:

Bugs and errors are fixed for free
Minor adjustments are made free of charge
Technical problems are solved for free.

15. Additional work after warranty period

15.1 After 14 days, additional work will be charged at a minimum rate of €70 per task. Should a task take longer than 1 hour, it will be charged at €75/hour.

15.2 Task Bundling: Customers can bundle multiple tasks and request them in a single request. As long as the total work remains under 1 hour, they pay only €70. This is advantageous for small adjustments that take less than 1 hour in total.

15.3 For customers who regularly require minor adjustments (text changes, adjusting images, etc.), we recommend the Maintenance package (€125/month). This package offers up to 4 hours of support per month for ongoing optimization, updates, and minor adjustments.

16. Liability

16.1 Studio Sascha is not liable for:

Loss of profit or loss of revenue
Reputational damage
Data loss (always make your own backups, unless otherwise agreed).

16.2 Studio Sascha is solely liable for direct damage resulting from a demonstrable error in the execution of the assignment. Total liability is hereby limited to the amount stated in article 16.3 (€1,500).

16.3 The total liability of Studio Sascha is limited to €1,500.

16.4 Studio Sascha is not responsible for matters over which it has no influence, such as:

Malfunctions or errors at external parties (such as hosting, domain registration, or plugins used);
The website not working properly in outdated browsers;
Burglary or hacks by third parties, unless Studio Sascha can be accused of gross negligence in security.

16.5 Any claim for compensation shall lapse if it is not reported in writing to Studio Sascha within 14 days of discovering the damage.

17. Termination of the Agreement

17.1 Termination by the Customer

You may cancel the assignment in writing at any time with a notice period of 2 weeks. Please note the following:

The first installment of 50% is non-refundable. This covers the strategic intake, the target group analysis, and the capacity reserved in the planning.
If more work has already been performed than the first installment covers, Studio Sascha will charge the excess at the applicable hourly rate.
Work that has already been delivered remains paid for. Partially completed projects will not be refunded.
In the Google Ads process, the prepaid amount is non-refundable, because the majority of the work lies in the setup.
The maintenance subscription can be cancelled with a notice period of one month.

17.2 Stopping by Studio Sascha

I have the right to terminate the collaboration or take the website (temporarily) offline if:

An invoice (for example, for additional work or maintenance) has not been paid within 14 days after a written reminder.
There is repeated non-payment on multiple invoices.
The agreements in these Terms and Conditions are not complied with by the Customer.
In other cases, Studio Sascha applies a notice period of 2 weeks.

17.3 Upon termination:

Studio Sascha delivers already completed parts
Incomplete files cannot be delivered.
Hosting details and domains are being transferred

18. Changes to Terms and Conditions

18.1 Studio Sascha reserves the right to amend these Terms and Conditions.

18.2 Amendments do not apply to existing Agreements, unless otherwise agreed.

18.3 Customers are informed of important changes via email and the customer portal.

19. Dispute Resolution

19.1 Do we have a difference of opinion? Then we promise to first do our utmost to resolve this together in a good conversation.

19.2 If we really cannot reach an agreement together, we will submit the dispute to the competent court of the District Court of North Holland, unless consumer law provides otherwise.

19.3 All our agreements and these Terms and Conditions are exclusively governed by Dutch law.

Studio Sascha : the sole proprietorship Studio Sascha, established in the Netherlands, registered with the Chamber of Commerce under number 94563543.

Client: the natural person or legal entity that enters into an agreement with Studio Sascha.

Agreement: the assignment agreement between Studio Sascha and the Client, in which the agreed work and conditions are set out.

Services: all work performed by Studio Sascha, including designing and building websites, developing a visual identity, managing Google Ads campaigns, and maintaining websites.

Track: the package chosen by the Customer, such as Basic, Standard, or Premium.

Delivery: the moment at which Studio Sascha submits the final result to the Client for approval.

Additional work: activities that fall outside the agreed assignment.
